Since educational institutions perform public functions and are subject to state education rules, Writ Petition under article article 102 of the Constitution of the People’s Republic of Bangladesh can be filed against them. The question of filing writs against educational institutions has assumed considerable importance recent years. The problem faced by educational institutions is today a result of socio economic changes in the society. The State is taking active part in educational matters keeping in view the constitutional mandadte. The changes in educational process and the legal awareness amongst educational elite have resulted in filing a plethora of cases against educational institutions before the courts. Various matters like admissions, reservations, examinations, students, indiscipline and teachers service matters are frequently coming up before the courts. The persons affected by the decisions of educational institutions are invariably resorting to the writ jurisdiction of the High Court Division.
